Terms of Use

1. Agreement to these terms

These Terms of Use (“Terms”) are a binding agreement between you and GROFIT (“we”, “us”, “our”) governing your use of the GROFIT mobile application for iOS and Android and the website grofit.cc (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility & your account

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us immediately at contact@grofit.cc if you suspect unauthorized use of your account.

3. Not medical advice

GROFIT provides fitness tracking, AI-estimated nutrition information, workout routines, and AI coaching for general informational and motivational purposes only. The Services are not a medical device and do not provide medical advice, diagnosis, or treatment.

Nutrition estimates generated from meal photos are approximations and may be inaccurate. AI coaching responses are generated automatically and may contain errors. Always consult a qualified healthcare professional before starting a new diet or exercise program, especially if you have a medical condition, are pregnant, or take medication. Never disregard professional medical advice because of something GROFIT told you. You use the Services at your own risk, and you are responsible for exercising safely and within your own limits.

4. Subscriptions & payments

• Free and paid plans. Parts of the Services are free; premium features require a paid subscription (“Pro”).
• Billing. Subscriptions purchased in the app are billed through the Apple App Store or Google Play under their terms. Prices are shown before you subscribe and may change with notice for future billing periods.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal, via your App Store or Google Play subscription settings.
• Refunds. Refunds for in-app purchases are handled by Apple or Google under their policies. Except where required by law, payments are non-refundable.

5. Your content & license to us

You retain ownership of the content you submit to the Services, including meal photos, logs, and messages (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, process, and display Your Content solely to operate and improve the Services for you — for example, analyzing meal photos with AI to estimate nutrition. As described in our Privacy Policy, we do not sell Your Content or use it for third-party advertising.

6. Acceptable use

You agree not to:

• Misuse the Services. Reverse engineer, scrape, disrupt, overload, or attempt unauthorized access to the Services or their systems.
• Abuse the AI features. Attempt to extract underlying models or prompts, generate unlawful or harmful content, or use automated tools to flood AI features.
• Violate laws or rights. Use the Services in violation of applicable law, upload content you have no right to share, or infringe anyone's intellectual property or privacy.
• Resell without permission. Rent, sell, or commercially exploit the Services or access to them without our written consent.

We may suspend or terminate accounts that violate these Terms.

7. Intellectual property

The Services — including the app, website, GROFIT name and logo, designs, and software — are owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the app on your devices for your own non-commercial use. No other rights are granted.

8. Termination

You may stop using the Services and delete your account at any time in the app settings. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services (with reasonable notice where practicable). Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) survive.

9. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that nutrition estimates, workout plans, or AI coaching are accurate, complete, or suitable for your circumstances.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services — including injuries or health outcomes related to exercise or nutrition decisions. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim (or USD 50 if you paid nothing). Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to the Services or Terms

We may modify or discontinue features at any time. We may also update these Terms; if changes are material, we will notify you in the app or by email before they take effect. Continuing to use the Services after changes take effect means you accept the updated Terms.

12. Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts located in India have exclusive jurisdiction over disputes arising from them — except where the mandatory consumer-protection laws of your country of residence provide otherwise.
